Fields of application
All business relations between NOFOX and the customer are conducted by the present general conditions as well as eventual other appendices duly signed by both sides. The signed contract means the acceptance of the terms of the offer, of our general conditions and of those of the possible web host. These remain valid as long as your site is available.
Website content
In accordance with the law, we don't create any sites with illegal content even indirectly (i.e. heinous, racist, sexist, claiming the superiority of a race, a sex or a nationality or that doesn't respect the copyrights (MP3, warez, DivX...). In the same way we do not create any site that contains sexual matter in any form.
Responsibility
We are in no case responsible of the content of your website. Once your website online, all the actions related to it are under your responsibility. If illegal or sexual contents are shown on your site, it will be removed by the host without notice and compensation.
NOFOX Objectives
We create a new website or upgrade one that already exists, according to your needs. All the work done is technical. The input of content can be done by you through the simple and effective update systems of NOFOX. However we stay at your disposal to do it for 35 CHF an hour.
Terms of payment
The payment of the requested service is divided in two parts:
The first one, 20% of the website price, is required when the contract is concluded (to be paid in the next ten days). Work will start after its reception.
The rest (80%) will be claimed at the end of the work through a bill (to be paid in the next ten days). The usufruct of your site is delivered to you when the total amount stipulated in the contract is received. Once the contract concluded and the pay-time exceeded, everyone must pay completely the required services. No transaction is refundable.
If the customer does not respect the terms of payment (after 2 reminders), NOFOX will interrupt the supply of the agreed services and, if necessary, even cancel the contract with immediate effect and without compensation. An amount of CHF 100.- will be charged for the resumption of the service.
Deadline
Except other mention written in the contract, we guarantee your website to be created in the maximal delay of two months.
However, we cannot guarantee the respect of the deadline if the necessary documents andor the working material supplied by the customer are not sent in time, defective or in case of force majeure.
Guarantee and Update
The finished site is guaranteed 100% functional. However, if errors occur we will correct them without any expenses for you if they are announced within three months after the setting on line of the website and if they do not occur after an external manipulation.
No update is included in the price of the site. Through our systems you will be able to make them without problem by yourself. If you want technical updates we can deliver you a new estimate.
Confidentiality
We guarantee a total confidentiality of your private data.
No information concerning you will be transmitted to third parties except the ones needed for the hosting service.
Rights of ownership
The customer guarantees that all the provided documents andor the working material are free of any copyright.
The domain name and the website are your property. The hosting of the files is a space rented by a company. The codes, according to the law on the copyright of October 9th, 1992, are the property of NOFOX. You are not allowed to sell or give to anyone a part or totality of our codes under legal pursuit’s penalty. The access to our codes is entirely private.
Agreement
The present contract and the services supplied by NOFOX are under the Swiss law. The legal base is in Lausanne (Vaud - Switzerland).
In case of dispute, it is the French version of these general conditions that will be valid.
